Carryover licence agreement and terms

These terms cover downloading, installing and using Carryover, and buying a licence key for it. They are written to be read, not to be impressive. Where the law gives you a right, these terms do not take it away.

Who you are contracting with

Carryover is made and licensed by Ryan Anstey, trading as FableForge, Flat 103, The Antigallican Hotel, 428 Woolwich Road, London SE7 8SU, [email protected] — "we" or "us", the licensor. You are the licensee.

The licence we grant you

A licence key gives you a perpetual, non-exclusive, non-transferable licence to install and use Carryover 1.x on up to three Macs that you own or control, for personal or business work. Carryover does not count the Macs a key is used on; the limit is on your honour. A key is not meant to be shared across a team or a pool of machines.

We are licensing the software to you, not selling it: ownership stays with us.

The free trial

Carryover runs for 14 days from first launch with every feature unlocked, with no account and no card. After 14 days you can still compare your Macs, but bringing things over, installing and keeping Macs in step need a licence key. The trial counts per Mac and is not meant to be restarted by reinstalling.

Updates

Every 1.x update is included in the price, for as long as we publish them. Updates arrive through the in-app updater, which fetches one small file from this site once a day. A future major version may be a paid upgrade; if so we will say so plainly before you have to decide anything, and your 1.x licence keeps working.

What Carryover does to your Mac — back up first

Carryover changes system settings and installs software. Depending on what you tick, it rewrites preferences for the Dock, Finder, trackpad, keyboard and other parts of macOS, restarts the Dock or Finder so a change takes effect, applies administrator-level settings with your password, installs Homebrew, Apple's Command Line Tools and Homebrew packages, and sends you to the App Store or a developer's website to install apps.

Before you use Carryover to change a Mac, make a full backup of it — Time Machine is fine. Carryover only changes what you tick and lists what it did in Activity, but it cannot promise to reverse every change, and some settings only take effect after you log out or restart. Settings that macOS stores in undocumented formats are applied only on macOS versions we have checked; Apple can change those formats in any update.

Software you install with Carryover

Carryover does not sell, licence or copy other people's software. Apps come from Apple's App Store, from Homebrew, or from their developers' own websites, and each one is licensed to you by its own developer under its own terms. You are responsible for having the right to install each app on the Mac you install it on. Homebrew and the packages it installs are maintained by their own projects, not by us.

What you may not do

Please do not redistribute Carryover or sell it on; publish or share your licence key, or use a key you did not buy; remove or work around the licence check; or reverse engineer, decompile or disassemble the app — except to the extent UK law permits you to do so whatever this clause says, for example for interoperability under the Copyright, Designs and Patents Act 1988.

Who owns Carryover

Carryover, its name, its icon and its code remain our property. Nothing here transfers any intellectual property to you beyond the licence described above.

How you buy: Paddle is our merchant of record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

In practice that means Paddle.com Market Ltd takes the payment, issues the invoice and handles tax, under its own buyer terms and privacy policy. This agreement governs your use of the software itself.

Prices, VAT and invoices

Carryover is £24, one time. Prices are in pounds sterling and include UK VAT where it applies. VAT or sales tax for other countries is calculated at checkout by Paddle, from the country you give it. Paddle issues the receipt or invoice, and that is the document to keep — it also carries the transaction id that recovers your key.

Cancelling, and the refund we give anyway

If you are a consumer, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you 14 days to cancel an online purchase. Your licence key is digital content supplied immediately after payment, so at checkout you consent to that immediate supply and acknowledge that the statutory right to cancel ends once the key is supplied.

We honour a 14-day, no-questions refund regardless. Ask within 14 days of buying and you get the money back — see the refund policy for how. A refund ends your licence and we delete the licence record, so the key can no longer be recovered. Carryover checks keys offline and we cannot switch a key off remotely, so by accepting a refund you agree to remove Carryover from your Macs. None of this affects your rights if the software is faulty, which is the next section.

What we promise, and the limits

If you bought as a consumer, the Consumer Rights Act 2015 requires digital content to be as described, fit for purpose and of satisfactory quality. Those rights apply in full and nothing in these terms reduces them — if Carryover falls short, you are entitled to a repair, a replacement or a refund as the Act provides.

Beyond those rights, Carryover is supplied as it is, without any further warranty. We cannot promise it is free of every defect, that every setting carries across on every Mac and every version of macOS, or that a third party's app, package or download will install or behave as you expect. You stay responsible for backing up your Macs before you change them.

Our total liability to you, for anything arising out of Carryover or these terms, is limited to the amount you paid for your licence. To the extent the law allows us to say so, we are not liable for loss of profit, loss of business or loss of data. Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Ending this licence

Your licence ends if you break these terms in a way you do not put right after we ask — publishing your key, for instance. It also ends if your purchase is refunded. When it ends, stop using Carryover and remove it from your Macs; the settings and apps already on your Macs stay yours. We may stop selling or updating Carryover at any time, which does not end a licence you already hold.

Which law applies

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you keep the benefit of the mandatory consumer protections of the law where you live, and you may bring proceedings in your local courts.
