Harbour licence agreement and terms

These terms cover downloading, installing and using Harbour, and buying a licence key for it. They are written to be read, not to be impressive. Where the law gives you a right, these terms do not take it away.

Who you are contracting with

Harbour is made and licensed by Ryan Anstey, trading as FableForge, Flat 103, The Antigallican Hotel, 428 Woolwich Road, London SE7 8SU, [email protected] — "we" or "us", the licensor. You are the licensee.

The licence we grant you

A licence key gives you a perpetual, non-exclusive, non-transferable licence to install and use Harbour 1.x on any Mac you own or control, for personal or business work. One licence covers one person. If two of you need Harbour, buy two keys; a key is not meant to be shared across a team or a pool of machines.

We are licensing the software to you, not selling it: ownership stays with us.

The free trial

Harbour runs for 14 days with every feature unlocked, with no account and no card. After 14 days you need a licence key to keep using it — your files, settings and activity log stay exactly where they are in the meantime. The trial counts per Mac and is not meant to be restarted by reinstalling.

Updates

Every 1.x update is included in the price, for as long as we publish them. Updates arrive through the in-app updater, which fetches one small file from this site once a day. If there is ever a 2.0 that costs money, we will say so plainly before you have to decide anything.

What you may not do

Please do not redistribute Harbour or sell it on; publish or share your licence key, or use a key you did not buy; remove or work around the licence check; or reverse engineer, decompile or disassemble the app — except to the extent UK law permits you to do so whatever this clause says, for example for interoperability under the Copyright, Designs and Patents Act 1988.

Who owns Harbour

Harbour, its name, its icon and its code remain our property. Nothing here transfers any intellectual property to you beyond the licence described above.

How you buy: Paddle is our merchant of record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

In practice that means Paddle.com Market Ltd takes the payment, issues the invoice and handles tax, under its own buyer terms and privacy policy. This agreement governs your use of the software itself.

Prices, VAT and invoices

Harbour is £19, one time. Prices are in pounds sterling and include UK VAT where it applies. VAT or sales tax for other countries is calculated at checkout by Paddle, from the country you give it. Paddle issues the receipt or invoice, and that is the document to keep — it also carries the transaction id that recovers your key.

Cancelling, and the refund we give anyway

If you are a consumer, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you 14 days to cancel an online purchase. Your licence key is digital content supplied immediately after payment, so at checkout you consent to that immediate supply and acknowledge that the statutory right to cancel ends once the key is supplied.

We honour a 14-day, no-questions refund regardless. Ask within 14 days of buying and you get the money back — see the refund policy for how. A refund ends your licence and we delete the licence record, and because Harbour checks keys offline rather than phoning home, by accepting a refund you agree to remove Harbour from your Macs. None of this affects your rights if the software is faulty, which is the next section.

What we promise, and the limits

If you bought as a consumer, the Consumer Rights Act 2015 requires digital content to be as described, fit for purpose and of satisfactory quality. Those rights apply in full and nothing in these terms reduces them — if Harbour falls short, you are entitled to a repair, a replacement or a refund as the Act provides.

Beyond those rights, Harbour is supplied as it is. We cannot promise it is free of every defect or that it suits one particular workflow. Harbour verifies copies, which is the whole point of it, but you stay responsible for your own backups: keep another copy of anything you cannot afford to lose.

Our total liability to you, for anything arising out of Harbour or these terms, is limited to the amount you paid for your licence. To the extent the law allows us to say so, we are not liable for loss of profit, loss of business or loss of data. Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Ending this licence

Your licence ends if you break these terms in a way you do not put right after we ask — publishing your key, for instance. It also ends if your purchase is refunded. When it ends, stop using Harbour and remove it from your Macs; your own files are yours, and Harbour never holds them hostage. We may stop selling or updating Harbour at any time, which does not end a licence you already hold.

Which law applies

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you keep the benefit of the mandatory consumer protections of the law where you live, and you may bring proceedings in your local courts.
